We are committed to compliance with the Privacy Act 1988 (Cth) (Privacy Act) and Schedule 1 of the Privacy Act the Australian Privacy Principles when agreed to with our clients.
All directors and employees of BH Lawyers must comply with this policy and carry out periodic training regarding this policy and other privacy related policies of BH Lawyers.
WHAT IS PERSONAL INFORMATION
Personal information is defined in the Privacy act as information or an opinion about an identified individual or an individual who is reasonably identifiable:

whether the information or opinion is recorded in a material form or not.

Personal information also extends to Personal insolvency Information under s6U of the privacy Act.
Sensitive Information is defined in the Privacy Act as information or an opinion about an individual's:

membership of a political association; or
religious beliefs or affiliations; or
philosophical beliefs; or
membership of a professional or trade association; or
membership of a trade union; or
sexual orientation or practices; or
criminal record;
that is also personal information; or
health information about an individual; or
genetic information about an individual that is not otherwise health information; or
biometric information that is to be used for the purpose of automated biometric verification or biometric identification; or
biometric templates.
​In the course of performing our legal services or activities associated with the Legal services, sensitive information may be collected. We may only collect sensitive information with your consent and where we are legally authorised to do so.
WE MAY REQUIRE YOUR PERSONAL INFORMATION
When dealing with us, we will most likely require you to identify yourself to be able to supply you with legal services or for us to comply with our legal obligations.
In the Course of our duties, we may need to collect information regarding yourself or other people, that falls under the definition of Personal Information or Personal Insolvency Information. It is incumbent on you to inform any third party that you are supplying us with such information and direct them to this privacy policy.

The nature of the personal information we collect and store can include; full names, contact details, date of birth, employment details, banking details and other background personal information.
COLLECTION OF PERSONAL INFORMATION
We may collect your personal information directly from you when you visit our website, apply for or become an employee, become a client, request our services. We may also collect information from third parties about you from our clients, other parties involved in legal matters, Courts and other government agencies, public records, state boards and bodies, your employer, financial institution’s. Our website may use cookies supplied by third parties such as Google Analytics that may also collect analytic information (OS, pages, length of visit etc) that is not personally identifiable that is used for statistical and analysis purposes to improve our website.
USE OF PERSONAL INFORMATION
BH Lawyers will not disclose Personal Information without consent from the person who the information is about unless disclosure is permitted or required by Law.
The reason for our collection and use of personal information generally extends to, but is not limited to the following reasons:

Providing legal services.
Management of our firm including but not limited to invoicing, account management, storage of records, and marketing activities.

Generally, we will need to collect personal information to provide Legal Services/advice to you in compliance with our duties under the law. Any personal information collected stored and used will be done so in compliance with the Privacy Act.
DISCLOSURE OF PERSONAL INFORMATION

To third party Agents instructed by us to carry out duties necessary to deal with your matter.
To our technology service providers for the purpose of maintaining and upgrading our systems.
To Courts Tribunals, other regulatory authorities, and credit reporting agency in circumstances where you have failed to pay for services provided by us.

To Financial institutions for the purpose of invoicing and payments.

You have the right to access personal information we hold about you. Please contact us to do so and we will respond. We may not be able to provide you with certain information where it is unlawful to disclose or legal disputes are proceeding.
